These conditions of use regulate access to and use of the ROAMS TIC S.L. website and its contents.

They must be observed and complied with by any person accessing, browsing or using the Website. Please use the ROAMS corporate website responsibly, and before continuing read these conditions of use, the privacy policy and the cookies policy, as their content is binding on you as a User of the same. If you do not agree with the Conditions of Use, do not access, browse or use the Website.

In compliance with the obligations established and in accordance with Article 10 of Law 34/2002 of 11 July 2002 on information society services and electronic commerce, Law 7/1998 of 13 April 1998 on general contracting conditions and Royal Legislative Decree 1/2007 of 16 November 2007, approving the revised text of the General Law for the Defence of Consumers and Users, we hereby inform you of the identification details of the owner of the website:

Roams operates as an independent price comparator, operating as a service company under the protection of Law 34/2002 of 11 July, on information society services and electronic commerce. In order to guarantee the correct provision of our services and to ensure that the User (as defined below) understands how we provide our services, ROAMS makes these Legal Conditions available to you:

LEGAL CONDITIONS AND THEIR ACCEPTANCE

The website ‘Roams’ has been created by Roams TIC SL with informative character to provide any individual and / or company (hereinafter, the ‘User’) information about products and services provided by telecommunications operators, energy, insurance and finance in the Spanish market, being the domain name www.theroams.co.uk registered in favour of Roams (hereinafter, the ‘Website’).

Please read these legal conditions carefully, since the mere access to the portal, the use of the contents offered therein as well as the sending of queries and complaints, and in general, any act of a similar nature to the above, attributes the condition of User of the same, and implies full and unreserved acceptance of these conditions included in this document in the latest version published by Roams at the very moment in which the User accesses the Website. Otherwise, the User must leave the Website.

Roams reserves the right to carry out, at any time and without prior notice, any modification or update of the contents and services, of these General Conditions and, in general, of any elements that make up the design and configuration of the Website.

Access to the Website is free of charge for the User and does not require prior subscription or registration, although it does require acceptance of these Conditions. This legal information is completed with the Privacy Policy and the Cookies Policy of this website.

The User accesses the Website under his or her sole responsibility. Therefore, the User shall be solely responsible for any damage or harm, direct or indirect, that may be caused to another person due to non-compliance with the conditions set out in this section, as well as for damages caused to ROAMS due to incorrect use of its services and for providing data that is not true, accurate, complete and up to date.

The use of the services provided by Roams is exclusively personal. The use of the Website for commercial purposes or within the framework of an employment relationship in the field of intermediation of services is expressly prohibited.

Roams reserves the right to take any legal action it deems appropriate for fraudulent use of the services as well as for any contravention of the present conditions contained in this Legal Notice and the Privacy Policy. In addition and independently of the contractual penalty, we may demand compensation for any damages caused.

By way of example but not limitation, the User:

WHAT SERVICES WE PROVIDE

Internet and telephony advisory service

ROAMS has developed a platform for comparing and providing information on the prices of electronic communications services, i.e. landline and mobile telephony services, internet, fibre and television on demand (hereinafter, the ‘Service’), which, based on the information and data provided by any User, informs the User of the best prices available for the products or services requested by the User, acting at all times in an impartial, objective and transparent manner, as an independent comparator.

HOW WE PROVIDE THE SERVICE

Based on the needs of the Users, the Website makes available a comparator that analyses the best selected products and services, where the User can analyse the different options, price, conditions and services advertised by the different companies and that fit their needs and profile. In our comparisons we may incorporate information such as contact information, reviews or customer opinions, among others.

The rates and prices of services or products will generally include VAT and any other charges or taxes that may apply, any other amount not included will be detailed in the offer, so please read the terms and conditions of the offer carefully.

Roams conducts its business in a way that is free of any links to any supplier or trader. Roams' advice is based on independence, providing its services in an impartial way, from the point of view of the adequacy to the User's needs.

It should be noted that these rates and offers are provided directly by the companies providing the product or service in question, so Roams does not intervene legally in their content (in particular, and among others, does not prepare the conditions, determines them, accepts proposals, validates their contents, certifies the correctness and legality of the same) and Roams has no responsibility whatsoever for them.

Likewise, the rates and prices shown may be modified by their suppliers at any time, so we recommend that you check with the companies in question before contracting the product or service selected.

In no case, the information provided and the information action carried out by Roams will be intended to assist in the conclusion or subscription of a contract for the provision of services or to intervene in any contractual relationship that may eventually occur between the Companies and their customers.

Therefore, if after evaluating all the rates and prices we show as a result of the requested comparison, you decide to sign up for any of them, you should bear in mind that you will be signing up directly with the company you have chosen.

To do so, ROAMS will contact the company providing the selected service.

How do we carry out this communication?

Users who show interest in any of the products offered by the different companies will be directed to them:

• By means of a link that will redirect you to the website of the company providing the service.
• By providing you with a telephone number of the company providing the service, where you will be able to contract directly with them.
• By the possibility of filling in a form, where you can leave your telephone number, to receive a call from an operator of the company later.

ROAMS shall not be liable for any damages that may be suffered as a result of the information provided by the suppliers of the products and/or services, nor for any possible contingencies that may arise during the course of the relationship you maintain with the supplier of the product and/or service during the term of the contract signed with them or after its termination, nor shall it be liable if the product or service chosen is no longer available at the time of contracting it.

RESPONSIBILITIES AND WARRANTIES

Responsibility for the Use of the Website

As a User, you agree to use the Website and the Platform ‘as is’, without any kind of guarantee.

ROAMS declines all responsibility for the use made of the data published on its Website. The User is solely responsible for any infringements which may be incurred or damages which may be caused by the use of the Website, and ROAMS, its partners, collaborators, employees and representatives shall be exonerated from any kind of liability which may arise from the actions of the User.

The User is solely liable for any claim or legal action, judicial or extrajudicial, brought by third parties against the company based on the User's use of the Website. Where applicable, the User shall bear any expenses, costs and compensation incurred by ROAMS as a result of such claims or legal action.

Liability for the operation of the Website

1. ROAMS shall be exempt from all liability and damages arising from the operation of the Service and the Website, as well as from the use or impossibility of use by the User, including in particular acts of God, force majeure and, in general, any other cause beyond the reasonable control of ROAMS and causes which may cause the Services to be totally or partially inoperative. Specifically, ROAMS disclaims any liability with regard to damages arising from errors, delays, interruptions in transmission, incorrect content, loss or cancellation of your data, computer viruses or system or line failures
2. Likewise, ROAMS also excludes any liability that may arise from delays or blockages in the operation of this electronic system caused by deficiencies or overloading of telephone lines or the Internet, as well as damage caused by third parties through unlawful interference beyond the control of the company.
3. ROAMS is entitled to temporarily suspend, without prior notice, access to the website for maintenance, repair, updating or improvement operations.

Liability for content and links

1. ROAMS uses all reasonable efforts and means to provide up-to-date and reliable information on the Website. All the information and data offered through the Website are obtained directly and automatically from the operators who provide or offer the products and services and are not checked or verified individually by ROAMS before they are published. Neither ROAMS nor its directors, employees, subcontractors, suppliers or any other party involved in the creation, production or delivery of the Services shall be liable to the User for any claims based on any loss of profit or income, material or personal damage, inaccuracy of data, detrimental reliance, inability to achieve expected results, income or savings, economic loss of any kind (including, without limitation, the cost of obtaining substitute products), as a result of the use, misuse of or access to the Web Site or having used and relied on information obtained from the Web Site and the Services.

The websites and other links from which the User may access the ROAMS Website are owned and managed by other companies, and ROAMS shall not be responsible for their operation, content or the products or services they offer. ROAMS therefore declines any responsibility for information found outside this Website and not managed directly by our website. Users and, in general, any natural or legal person who intends to establish a hyperlink or technical link from their website to the Website (the ‘Hyperlink’) must obtain prior written authorisation from ROAMS.

ROAMS does not itself or through third parties offer or market the information, content and services available on the Linked Sites, nor does it approve, supervise or control in any way whatsoever the content and services and any material of any kind existing on the same, and the User assumes exclusive responsibility for browsing through the same.

GENERAL

If any clause of these General Conditions is declared totally or partially null and void or ineffective, it will only affect that provision or part of it that is null and void or ineffective, with the rest of the General Conditions remaining in force in all other respects.
